User Agreement

This document serves as an agreement ("User Agreement" or "Agreement") between you and TheBlueTalk (“TBT”, "we", "us", or "our"). By outlining the terms under which you may utilize the TheBlueTalk website and its associated services—including discussion forums, messaging features, TheBlueTalk mobile applications, and social media platforms (collectively referred to as "TheBlueTalk")—this Agreement aims to foster a respectful, open environment for the exchange of news, ideas, personal experiences, links, and entertainment.
By entering into this Agreement, you acknowledge that you have fully read, understood, and consent to adhere to its terms. Should you find the terms of this Agreement unacceptable, you are advised against using TheBlueTalk. Additionally, we recommend reviewing TheBlueTalk's privacy policy, which details our data collection and usage practices.
General Clauses of TheBlueTalk User Agreement
Access to TheBlueTalk:

We reserve the right to, without prior notice and at our discretion, restrict or terminate your access to TheBlueTalk or delete any content you have posted on the platform, should you violate this Agreement or for any other reason we deem appropriate. Your use of TheBlueTalk implies consent to our management and oversight of the platform, although we do not commit to monitoring it continuously.

Permitted Use of TheBlueTalk:

TheBlueTalk is intended solely for personal and lawful use. It is not permissible to use TheBlueTalk for illegal activities, violating others' privacy, or infringing upon the intellectual property or other rights of individuals or entities.

Purpose of TheBlueTalk:

The platform is designed as a space for social interaction, sharing user-generated news, exchanging ideas, and entertainment purposes. We bear no responsibility for any decisions you make based on information found on TheBlueTalk.

TheBlueTalk as a Non-Marketplace:

TheBlueTalk is not designed to function as a marketplace for goods or services. Accordingly, any transactions you engage in are solely your responsibility. The platform must not be used for the exchange of illegal goods or services nor for the promotion of any products or services.

CONTENT ON THEBLUETALK
TheBlueTalk's Content:
TheBlueTalk hosts a variety of materials including graphics, text, audio, software, code, website compilations, photographs, images, videos, the overall design or "look and feel" of the website, and advertisements provided by us or our licensors, collectively known as "TheBlueTalk Content." This content is safeguarded by intellectual property rights, including copyright and other proprietary rights, both in the United States and internationally.
We provide you with the authorization to access TheBlueTalk Content as outlined in this agreement. Unauthorized usage, reproduction, modification, distribution, performance, or public display of TheBlueTalk Content, beyond what is allowed by fair use or specifically authorized by us in writing, is prohibited.
Your Content:

You maintain ownership over any original content, including copyrighted materials or information, that you contribute to TheBlueTalk ("User Content"), with certain exceptions detailed herein. When you submit User Content to TheBlueTalk, you grant us a royalty-free, unlimited, perpetual, irrevocable, non-exclusive, global license to use, modify, distribute, perform, and display your User Content in any medium for any purpose, including commercial objectives. You also allow us to enable others to do the same. You confirm that you have the legal right to share anything you post and that your User Content does not infringe upon the copyright, trade secrets, trademarks, or any other personal or proprietary rights of others.

Disclaimer Regarding User Content:

We accept no responsibility for, do not endorse, and are not liable for any User Content shared by you on TheBlueTalk.

TheBlueTalk and External Links:

TheBlueTalk includes numerous links to third-party sites provided by our users. We hold no accountability for the content or activities of any linked third-party websites or services. By posting links, you agree to assume full legal responsibility, acknowledging that this agreement and our privacy policy do not extend to third-party website content. We recommend reviewing the terms and privacy policies of those sites to fully understand your rights.

RULES AND GUIDELINES
Your Engagement on TheBlueTalk

By participating on TheBlueTalk, you agree to abide by our Content Rules. These rules aim to ensure safety, protect minors, maintain TheBlueTalk's functionality, and promote accountability for your actions on the platform.

Zero Tolerance for Spam

Posting materials considered as spam, such as unsolicited self-promotion or other irrelevant content (including graphics, text, photos, videos, and audio), is prohibited. Such content detracts from the quality of TheBlueTalk experience for others. We reserve the discretion to identify what constitutes spam on an individual basis and will moderate comments accordingly.

Proper Use of TheBlueTalk

You agree not to disrupt TheBlueTalk's services, upload malicious code, hinder others' use of TheBlueTalk, manipulate the platform's voting or systems, or assist in any misuse of TheBlueTalk.

Age Restriction

TheBlueTalk is not designed for individuals under the age of 13, and we do not intentionally collect personal information from such individuals.

DMCA AND COPYRIGHT INFRIGEMENT
TheBlueTalk adheres to the Digital Millennium Copyright Act ("DMCA") and will respond to valid infringement notices. We reserve the right to remove content that infringes on another's copyright. If you encounter content on TheBlueTalk infringing on your copyright, you may submit a DMCA notice via our support contact page, including the following information:
- The copyright owner's or their agent's physical or electronic signature;
- Identification of the copyrighted work claimed to have been infringed, or a list of such works;
- The URL or a detailed description to help us locate the allegedly infringing materials;
- Your contact information, including name, address, email, and phone number;
- A statement of good faith belief that the disputed use is not authorized by the copyright owner, agent, or the law;
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
Falsely claiming copyright infringement can lead to legal penalties. Consulting an attorney before submitting a DMCA notice is advisable.
ADDITIONAL LEGAL TERMS
Please review the following sections carefully. They apply to the fullest extent that the law allows. In jurisdictions where disclaimers of implied warranties or limitations on liability are not permitted, some of the provisions below may not apply.
Indemnification

You are solely responsible for your actions and the content you contribute to TheBlueTalk. You will not hold us accountable for any legal claims arising from your content or actions that violate the law or someone else's rights. You agree to indemnify and hold harmless TheBlueTalk, its affiliates, officers, directors, employees, agents, and third-party service providers from any legal claims, damages, expenses, and liabilities, including legal fees, resulting from your use of TheBlueTalk, your breach of this agreement, or your infringement of any third-party rights.

Warranty Disclaimer

TheBlueTalk is offered "as is" without any warranties. We, along with our affiliates and third-party service providers, disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. You bear all risks associated with any damage to your device or loss of data resulting from using TheBlueTalk. We do not guarantee uninterrupted or error-free operation of TheBlueTalk.

Limitation of Liability

We shall not be liable for any indirect, special, incidental, consequential, or exemplary damages arising from your use or inability to use TheBlueTalk. This includes damages for lost profits, goodwill, use, or data. This limitation applies even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations on liability, so these limitations may not apply to you. You may also have other rights that vary by jurisdiction. You also agree to release us and our affiliates, and third-party service providers from any claims and damages of any kind related to your use of TheBlueTalk.

Governing Law

We hope you enjoy using TheBlueTalk. For any disputes, we encourage you to contact us directly to seek a resolution. Any legal issues will be governed by the laws of the State of California, without regard to its conflict of law provisions, and you agree to the jurisdiction of courts located in Los Angeles County, California.

Severability and Enforcement

If any part of this agreement is found to be unenforceable, we'll adjust it as necessary to make it enforceable while preserving its intent. If it cannot be adjusted, it will be excluded from the agreement. Our failure to enforce any part of this agreement is not a waiver of our right to do so later.

Changes to This Agreement

This document is the complete agreement between you and us regarding TheBlueTalk, superseding all previous agreements. We may update these terms, and if we make significant changes, we'll provide notice and keep the previous version archived on our site. By continuing to use TheBlueTalk after changes are made, you accept the updated terms.
